1.2. These website Terms and Conditions (“Terms and Conditions”) govern the ordering, sale and delivery of goods, and the use of the Website.
1.3. These Terms and Conditions are binding and enforceable against every person that accesses or uses this Website (“you”, “your” or “user”). By continuing to use this Website, you acknowledge that you have read and agree to be bound by these Terms and Conditions.
1.4. The Website enables you to shop online for an extensive range of goods which may include fashion garments, clothing, accessories, apparel (“Goods”).

2.1. These Terms and Conditions apply to users who are consumers for purposes of the Consumer Protection Act, 68 of 2008 (the “CPA”).
2.2. These Terms and Conditions contain provisions that appear in similar text and style to this clause and which –

2.2.2. may create risk or liability for the user; and/or
2.2.3. may compel the user to indemnify Blush Affluent and/or
2.2.4. serves as an acknowledgement, by the user, of a fact.
2.3. Your attention is drawn to these Terms and Conditions because they are important and should be carefully noted.
2.4. If there is any provision in these Terms and Conditions that you do not understand, it is your responsibility to ask Blush Affluent to explain it to you before you accept the Terms and Conditions or continue using the Website.
2.5. Nothing in these Terms and Conditions is intended or must be understood to unlawfully restrict, limit or avoid any right or obligation, as the case may be, created for either you or Blush Affluent in terms of the CPA.
2.6. Blush Affluent permits the use of this Website subject to the Terms and Conditions. By using this Website in any way, you shall be deemed to have accepted all the Terms and Conditions unconditionally. You must not use this Website if you do not agree to the Terms and Conditions.
2.7. These Terms and Conditions are divided into three sections, as follows:

PART A – ORDERS AND SALES
- Use of the Website
3.1. By using the Website you warrant that you are 18 (eighteen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or if you are not legally permitted to enter into a binding agreement, then you may use the Website only with the involvement and supervision of your parent or legal guardian. If your parent or legal guardian supervises you and gives his/her consent, then such person agrees to be bound to these Terms and Conditions and to be liable and responsible for you and all your obligations under these Terms and Conditions.
3.2. You agree that you will not in any way use any device, software or other instrument to interfere or attempt to interfere with the proper working of the Website. In addition, you agree that you will not in any way use any robot, spider, other automatic device, or manual process to monitor, copy, distribute or modify the Website or the information contained herein, without the prior written consent from an authorised Company representative (such consent is deemed given for standard search engine technology employed by Internet search websites to direct Internet users to this Website).
3.3. You may not use the Website to distribute material which is defamatory, offensive, contains or amounts to hate speech or is otherwise unlawful.
3.4. You may not in any way display, publish, copy, print, post or otherwise use the Website and/or the information contained therein without the express prior written consent of an authorised Company representative.
- Conclusion of sales and availability of stock
4.1. Users may place orders for Goods, which Blush Affluent may accept or reject. Whether or not Blush Affluent accepts an order depends on the availability of Goods, correctness of the information relating to the Goods (including without limitation the price) and receipt of payment or payment authorisation by Innate Couture for the Goods.
4.2. NOTE: Blush Affluent will indicate the acceptance of your order by delivering the Goods to you, and only at that point will an agreement of sale between you and Blush Affluent come into effect (the “Sale”). This is regardless of any communication from Blush Affluent stating that your order or payment has been confirmed. Blush Affluent will indicate the rejection of your order by cancelling it and, as soon as possible thereafter, refunding you for any amount already paid.
4.3. Orders may not be cancelled after receipt of payment of the Goods by Blush Affluent. After dispatch of your Goods, you may cancel the Sale only in accordance with the Returns Policy.
4.4. Placing Goods in a shopping basket without completing the purchase cycle does not constitute an order for such Goods, and as such, Goods may be removed from the shopping basket if stock is no longer available. You cannot hold Blush Affluent liable if such Goods are not available when you complete or attempt to complete the purchase cycle at a later stage.
4.5. You acknowledge that stock of all Goods on offer is limited. In the case of Goods for sale by Blush Affluent, Blush Affluent will take all reasonable efforts to monitor stock levels and ensure that when stock is no longer available, that offers thereof are discontinued on the Website. However, we cannot guarantee the availability of stock. When Goods are no longer available after placing an order, Blush Affluent will notify you and you will be entitled to a refund of the amount paid by you for such Goods.
5.1. We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.
5.2. Card transactions will be acquired for Blush Consulting (Pty) Ltd via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.
5.3. Payment can be made for Goods via –
5.3.1. Visa and Mastercard credit card: where payment is made by credit card, we may require additional information in order to authorise and/or verify the validity of payment. In such cases we reserve the right to withhold delivery until such time as the additional information is received by us and authorisation is obtained by us for the amounts. If we do not receive authorisation, your order for the Goods will be cancelled. You warrant that you are fully authorised to use the credit card supplied for purposes of paying the Goods. You also warrant that your credit card has sufficient available funds to cover all the costs incurred as a result of the services used on the Website;
5.4. You may contact us via email at firstname.lastname@example.org to obtain a full record of your payment. We will also send you email and SMS communications about your order and payment.
5.5. Once you have selected your payment method and you accept these Terms and Conditions, you will be directed to a link to a secure site for payment of the applicable purchase price for the Goods.
5.6. The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).
- Delivery of goods
6.1. Blush Affluent offers one method of delivery of Goods to you, which is via courier.
6.2. All deliveries within SA will be at no cost to you, provided that the total weight of the package does not exceed 5kg. In the event that the total weight of the package does exceed the maximum weight as stipulated, Blush Affluent will supply a quote to you as required.
6.3. In the case of international deliveries however, Blush Affluent will supply a quote for delivery which will be for your account, in addition to the total cost of your purchase.
6.4. If Blush Affluent accepts your order, we will deliver the Goods to you as soon as reasonably possible, but no later than 30 (thirty) days of receipt of your payment (“Delivery Period”). We will notify you if we are unable to deliver the Goods during the Delivery Period. You may then, within 7 (seven) days of receiving such notification elect whether or not to cancel your order for the Goods. If you elect to cancel your order, we will reimburse you for the purchase price.
We shall take all reasonable efforts to accurately reflect the description, availability, purchase price and delivery charges of Goods on the Website. However, should there be any errors of whatsoever nature on the Website (which are not due to our gross negligence), we shall not be liable for any loss, claim or expense relating to a transaction based on any error, save – in the case of any incorrect purchase price – to the extent of refunding you for any amount already paid, or otherwise as set out in the Returns Policy.
PART B – RETURNS POLICY
We want you to be happy with your purchase. If you are not completely satisfied, you can return the product to us and we will either repair / replace it or credit your account, subject to the terms below. This policy applies to products bought from Blush Affluent.
- Unwanted products
In general, you can return an unwanted product to us at no charge, provided:
- it is undamaged and unused, with the original labels and stickers still attached;
- it is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable);
- it is not missing any accessories or parts;
- it is not listed in section 9 – Products not eligible for return; and
- you log a return via email within 7 days of delivery to you or collection by you of the unwanted product. After 7 days, you can only return a product if it is defective within 1 month from delivery to or collection by you.
We will collect the product from you at no charge. Our courier is entitled to refuse collection of a product that is not properly packaged for transport.
Once we have inspected the product and validated your return, we will refund you with the purchase price of the product within 15 days of the return. Please bear in mind that refunds can take 5 – 10 working days to reflect in your account. We are entitled to refuse a return if the unwanted product is returned damaged, not in a re-saleable condition or missing any accessories.
Want to exchange?
Homeware items can be exchanged for a different size provided that such variation is available and is available at the same price as the product originally purchased. In such a case, we will collect the product from you and deliver the requested product to you at no charge. If such variation is not immediately available, we will refund you (if that is your preference) within 15 days of you emailing us about the return.
We reserve the right to inspect the product to validate your return.
Not what you ordered?
If we accidentally deliver the wrong product to you or if the product is not as described on the Website (or if it is missing any accessories), please notify us and we will collect the product from you at no charge. Once we have inspected the product and validated your return, we will, at your choice, deliver the correct product to you as soon as possible (if the correct product is available); or refund you with the purchase price of the product within 15 days of the return (if that is your preference).
- Products not eligible for returns
The following products are not eligible for a refund, exchange or credit:
- plates, glass ware, mugs, wooden accessories and rugs.
- lamps and Egyptian sheets.
- products which have been personalised for you or made to your specifications, unless defective.
- Products damaged on delivery
Should a product be damaged at the time of delivery / collection, please notify us of such delivery / collection by emailing us at email@example.com.
We will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will, at your choice, repair / replace the product as soon as possible (if such repair / replacement is possible) or refund you with the purchase price of the product (if that is your preference). Credits and refunds are normally handled within 15 days of logging/ emailing the return (bear in mind that refunds can take 5-10 working days to reflect in your account). Repairs and replacements could take longer, depending on stock / replacement availability.
- Defective products
We do our best to ensure that the products we deliver to you are of a high quality and without defects.
What is a defect? A defect is a material imperfection in the manufacture/ production of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances.
The following will NOT be regarded as defects and will not entitle you to a return under this section 11:
- faults resulting from normal wear and tear;
- damage arising from negligence, user abuse or incorrect usage of the product;
- damage arising from a failure to adequately care for the product;
- damage arising from unauthorised alterations to the product; and
- where the specifications of a product, although accurately described on the Website and generally fit for its intended purpose, do not suit you.
If you have received a product which turns out to be defective, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within 1 month after delivery / collection of the product.
You can do so by emailing us on info@blushaffluent and we will arrange to collect the product from you at no charge. Once we have inspected the product and validated your return, we will, at your choice, repair / replace the product (if such repair / replacement is possible) or refund you with the purchase price of the product (if that is your preference). Credits and refunds are normally handled within 15 days of logging/ emailing the return (bear in mind that refunds can take 5-10 working days to reflect in your account). Repairs and replacements could take longer, depending on stock / replacement availability.
Please provide suitable packaging for returning the product (it need not be the original packaging), as well as all accessories that were sold with the defective item when you return it to us – regardless of whether you request a repair / replacement or a refund. Our courier is entitled to refuse collection of a product that is not properly packaged for transport.
If you return a defective product to us, but you fail to return all of the accessories that were sold with that product, we are entitled (subject to applicable law) to refuse the return, only to replace the item that you did return, or to estimate the value of the missing accessories and only to credit or refund you in respect of the returned item.
If you return items to us by mistake and you want these returned to you, you may be liable to reimburse Blush Affluent the cost of having the product returned to you.
If you return a product that does not comply with this policy, you may be liable to reimburse Blush Affluent of collecting the product from you and the cost of having the product returned to you.
13.1. We respect your privacy and will take all reasonable measures to protect it, as more fully detailed below.
13.2. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from http://wwwpolity.org.za/attachment.php?aa_id=3569.
13.3. Should you decide to register as a user on the Website, we may require you to provide us with personal information which includes but is not limited to –
13.3.1. your name and surname;
13.3.2. your email address;
13.3.3. your physical address;
13.3.4. your gender;
13.3.5. your mobile number; and
13.3.6. your date of birth.
13.4. Should your personal information change, please inform us and provide us with updates to your personal information as soon as reasonably possible to enable us to update your personal information.
13.5. You may choose to provide additional personal information to us, in which event you agree to provide accurate and current information, and not to impersonate or misrepresent any person or entity or falsely state or otherwise misrepresent your affiliation with anyone or anything.
13.6. Subject to clause 9.6 below, we will not, without your express consent:

Whilst we will do all things reasonably necessary to protect your rights of privacy, we cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of your personal information, whilst in our possession, made by third parties who are not subject to our control, unless such disclosure is as a result of our gross negligence.

If you disclose your personal information to a third party, such as an entity which operates a website linked to this Website or anyone other than Blush Affluent, BLUSH AFFLUENT SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, HOWSOEVER ARISING, SUFFERED BY YOU AS A RESULT OF THE DISCLOSURE OF SUCH INFORMATION TO THE THIRD PARTY. This is because we do not regulate or control how that third party uses your personal information.

- Changes to these terms and conditions
14.1. Blush Affluent may, in its sole discretion, change any of these Terms and Conditions at any time. It is your responsibility to regularly check these Terms and Conditions and make sure that you are satisfied with the changes. Should you not be satisfied, you must not place any further orders on, or in any other way use, the Website.
14.2. Any such change will only apply to your use of this Website after the change is displayed on the Website. If you use the Website after such amended Terms and Conditions have been displayed on the Website, you will be deemed to have accepted such changes.

Although Goods sold from the Website may, under certain specifically defined circumstances, be under warranty, the Website itself and all information provided on the Website is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed in law.

Innate Couture cannot be held liable for any inaccurate information published on the Website and/or any incorrect prices displayed on the Website, save where such liability arises from the gross negligence or wilful misconduct of Innate Couture, its employees, agents or authorised representatives. 18.3. YOU HEREBY INDEMNIFY BLUSH AFFLUENT AGAINST ANY LOSS, CLAIM OR DAMAGE WHICH MAY BE SUFFERED BY YOURSELF OR ANY THIRD PARTY ARISING IN ANY WAY FROM YOUR USE OF THIS WEBSITE AND/OR ANY LINKED THIRD PARTY WEBSITE.
- Availability and termination
19.1. We will use reasonable endeavours to maintain the availability of the Website, except during scheduled maintenance periods, and reserve the right to discontinue providing the Website or any part thereof with or without notice to you.
19.2. Blush Affluent may in its sole discretion terminate, suspend and modify this Website, with or without notice to you. You agree that Blush Affluent will not be liable to you in the event that it chooses to suspend, modify or terminate this Website other than for processing any orders made by you prior to such time and to the extent possible.
19.3. If you fail to comply with your obligations under these Terms and Conditions, including any incident involving payment of the price of an order for any Goods, and you fail to remedy such failure within 7 (seven) days of notice to you by us, this may (in our sole discretion) lead to a suspension of your access to the Website without any prejudice to any claims for damages or otherwise that we may have against you.
- Governing law and jurisdiction
20.1. These Terms and Conditions and our relationship and/or any dispute arising from or in connection with these Terms and Conditions shall be governed and interpreted in accordance with the laws of the Republic of South Africa. Your continued use of the Website will constitute your consent and submission to the jurisdiction of the South African courts regarding all proceedings, transactions, applications or the like instituted by either party against the other, arising from any of these Terms and Conditions.
20.2. In the event of any dispute arising between you and Blush Affluent, you hereby consent to the non-exclusive jurisdiction of the High Court of the Republic of South Africa (Western Cape Division, Cape Town) notwithstanding that the quantum in the action or proceedings may otherwise fall below the monetary jurisdiction of that court.
20.3. Nothing in this clause 16 or the Terms and Conditions limit your right to approach any court, tribunal or forum of competent jurisdiction in terms of the CPA.
21.1. Blush Affluent hereby selects Unit 2, 28 Kya North Park, Kya Sands, Johannesburg, South Africa, 1700 as its address for the service of all formal notices and legal processes in connection with these Terms and Conditions (“nominated address”). Blush Affluent may change this address from time to time by updating these Terms and Conditions.
21.2. You hereby select the address specified on the Goods order form as your nominated address, but you may change it to any other physical address by giving Innate Couture not less than 7 days’ notice in writing.
21.3. Notices must be sent either by hand, prepaid registered post or email and must be in English. All notices sent –
21.3.1. by hand will be deemed to have been received on the date of delivery;
21.3.2. by prepaid registered post, will be deemed to have been received 10 days after the date of posting;
21.3.3. by email will be deemed to have been on the date indicated in the “Read Receipt” notification. ALL EMAIL COMMUNICATIONS BETWEEN YOU AND US MUST MAKE USE OF THE “READ RECEIPT” FUNCTION to serve as proof that an email has been received.

23.3. Any failure on the part of you or Blush Affluent to enforce any right in terms hereof shall not constitute a waiver of that right.
23.4. If any term or condition contained herein is declared invalid, the remaining terms and conditions will remain in full force and effect.
23.5. No variation, addition, deletion, or agreed cancellation of the Terms and Conditions will be of any force or effect unless in writing and accepted by or on behalf of the parties hereto.
23.6. No indulgence, extension of time, relaxation or latitude which any party (the “grantor”) may show grant or allow to the other (the “grantee”) shall constitute a waiver by the grantor of any of the grantor’s rights and the grantor shall not thereby be prejudiced or stopped from exercising any of its rights against the grantee which may have arisen in the past or which might arise in the future.
23.7. These Terms and Conditions contain the whole agreement between you and Blush Affluent and no other warranty or undertaking is valid, unless contained in this document between the parties.
